Civil Litigation

In Tennessee, both oral and written contracts may be enforced. However, there are circumstances in which only written contracts are enforced. Under the Statute of Frauds (Tennessee Code section 29-2-101(a)(4)), for example, a real estate contract may be invalidated if it is not adequately memorialized in writing and signed. In some exceptional cases, however, Tennessee courts have enforced real estate contracts not in writing under the doctrine of equitable estoppel in order to prevent fraud.

Criminal Defense

The criminal defense matters that we handle include DUI cases, marijuana offenses and other drug crimes, assault and aggravated assault, domestic assault, white-collar crimes, sex crimes, traffic violations, and vehicular assault. Severe punishments may be imposed when a defendant is convicted. For example, Tennessee Code section 39-17-417 prohibits the manufacture, delivery, sale, or possession with intent to manufacture, deliver, or sell a controlled substance. A violation of this law that involves a Schedule I controlled substance is a Class B felony. Fines imposed for a conviction may reach up to $100,000, and a defendant may spend years in prison.

However, the prosecution must prove each element of its case beyond a reasonable doubt, and a knowledgeable criminal defense attorney can help you hold it to this high standard. For example, there are numerous rules that the police and prosecution must follow to respect the rights of criminal defendants. If they fail to follow them, it may be possible to get a case dismissed or the charges reduced. Except in some limited circumstances, the police must have probable cause to search your car, home, or person. If evidence of a crime is obtained without probable cause to search, the evidence may be suppressed, thereby undermining the prosecution’s case.

Family Law

We handle family law matters involving divorce, child custody, orders of protection, post-divorce matters, parental relocation, and grandparents’ rights. If you are divorcing your spouse, one of you must establish one of the many grounds for divorce under state law. Grounds for divorce include irreconcilable differences, impotency, bigamy, adultery, willful desertion for one year, some criminal convictions, and habitual drunkenness or narcotic drug abuse, among others.

Often, other issues are a source of contention during a Tennessee divorce, and we can assist you with those as well. If a plaintiff is less than 50% responsible for an accident, he or she still can potentially recover damages in an amount proportionate to the defendant’s degree of fault. Common forms of compensation in these cases include medical expenses, the costs of future treatment, lost income and earning capacity, property damage, and pain and suffering.
